Welcome to picovix! These Terms of Service ("Terms") govern your access to and use of our AI-powered video generation platform and services. By accessing or using picovix, you agree to be bound by these Terms.

Age Restriction: This app is intended for users aged 16 and above. Users are strictly prohibited from generating pornographic, sexually explicit, or illegal content.

If you do not agree to these Terms, you may not access or use our service. If you are using the service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Important: These Terms include an arbitration agreement and class action waiver that affect your legal rights. Please read them carefully.

picovix provides an AI-powered video generation service that allows users to:

• Upload personal photos or videos
• Select video templates or styles
• Generate AI-enhanced video content with face synthesis or animation
• Save, share, and manage generated results
• View and manage a personal creation history

Our service uses artificial intelligence and machine learning technology to process user content and generate personalized video results. Results are simulations and may not perfectly reflect real-life appearance.

You must be at least 16 years old to use picovix. Users under 16 are strictly prohibited from using our service.

To use certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or for any other reason at our sole discretion.

You retain all rights to photos, videos, and content you upload ("User Content"). By uploading User Content, you grant picovix a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and process your content solely for the purpose of providing and improving our services.

You agree NOT to upload content that:

• Contains nudity, sexually explicit material, or pornography
• Depicts minors in inappropriate situations
• Violates intellectual property rights of others
• Contains hate speech, harassment, or discriminatory content
• Promotes violence, illegal activities, or self-harm
• Includes personal information of others without consent
• Contains malware, viruses, or malicious code

We reserve the right to review, monitor, and remove any User Content that violates these Terms. However, we are not obligated to pre-screen content and do not assume responsibility for User Content.

You represent and warrant that you have all necessary rights, permissions, and consents to upload photos or videos containing identifiable individuals. You are solely responsible for ensuring you have proper authorization.

Our AI-generated videos are simulations created using artificial intelligence. These visualizations:

• Are approximations and may not be 100% accurate
• Do not guarantee real-life appearance or movement
• May contain imperfections or artifacts from AI processing
• Should not be used for identity reproduction or impersonation

We do not warrant that AI-generated results will be error-free, accurate, or meet your expectations. Use of results is at your own risk.

Your uploaded photos and generated results may be used to train and improve our AI models, always in accordance with our Privacy Policy. You can opt out of this by contacting us at picovix.office@gmail.com.

You agree NOT to:

• Use the service for any illegal or unauthorized purpose
• Attempt to reverse engineer, decompile, or extract our AI models
• Use automated tools (bots, scrapers) to access the service
• Circumvent any security features or access restrictions
• Upload malicious code or attempt to interfere with service operation
• Impersonate others or misrepresent your affiliation
• Collect or harvest information about other users
• Use the service to create deepfakes or misleading content
• Generate pornographic, sexually explicit, or illegal content using our AI services
• Resell, redistribute, or commercialize our service without permission
• Use results for commercial purposes without a commercial license

picovix and all content, features, and functionality (including but not limited to software, AI models, design, text, graphics, logos) are owned by picovix and are protected by international copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our service for personal, non-commercial purposes, subject to these Terms.

picovix may offer both free and paid subscription tiers. Paid features may include:

• Unlimited video generations
• Access to premium video styles
• Higher resolution output
• Priority AI processing
• Commercial usage rights

For paid subscriptions:

• You will be billed in advance on a recurring basis (monthly or annually)
• Subscriptions automatically renew unless cancelled
• Prices are subject to change with 30 days notice
• All payments are non-refundable except as required by law

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will retain access until then, but no refunds will be provided for partial periods.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Specifically, we do NOT warrant that:

• The service will be uninterrupted, timely, secure, or error-free
• Results will be accurate, reliable, or meet your expectations
• Any errors or defects will be corrected
• The service is free of viruses or harmful components
• AI-generated videos represent real-life likeness or motion

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PICOVIX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

You agree to indemnify, defend, and hold harmless picovix, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the service
• Your violation of these Terms
• Your User Content or photos you upload
• Your violation of any rights of others
• Your violation of any applicable laws or regulations

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy. By using picovix, you consent to our data practices as described in the Privacy Policy.

Key points:

• We collect photos, account information, and usage data
• Your photos are stored securely and never shared publicly
• We use data to provide services and improve AI models
• You can delete your photos and account at any time
• We comply with GDPR, CCPA, and other privacy regulations

Our service may contain links to third-party websites, services, or resources. We are not responsible for:

• The availability, accuracy, or content of third-party sites
• Third-party privacy practices or terms of service
• Any damages or losses caused by third-party interactions

Your use of third-party services is at your own risk and subject to their terms.

We reserve the right to:

• Modify, suspend, or discontinue any part of the service
• Add or remove features at any time
• Change pricing with 30 days advance notice
• Impose limits on usage or storage

We will attempt to notify you of material changes, but are not obligated to do so. Continued use after changes constitutes acceptance.

You may terminate your account at any time by contacting picovix.office@gmail.com.

We may terminate or suspend your access immediately, without notice, for:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Extended periods of inactivity
• At our sole discretion for any reason

Upon termination: (1) your right to use the service ends immediately, (2) we may delete your account and User Content after 30 days, (3) provisions that should survive termination will remain in effect.

Before filing a claim, you agree to first contact us at picovix.office@gmail.com to attempt to resolve the dispute informally. We will work in good faith to resolve issues within 60 days.

If informal resolution fails, you agree that disputes will be resolved through binding arbitration rather than in court, except as noted below. Arbitration will be conducted by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.

YOU AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY, AND NOT AS A CLASS ACTION, CONSOLIDATED ACTION, OR REPRESENTATIVE ACTION. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

Either party may bring a claim in small claims court or seek injunctive relief in court to protect intellectual property rights.

These Terms are governed by and construed in accordance with the laws of the Republic of Singapore, without regard to its conflict of law principles.

For disputes not subject to arbitration, you agree to the exclusive jurisdiction of the courts located in Singapore.

We may update these Terms from time to time. When we make material changes:

• We will update the "Last Updated" date at the top
• We will notify you via email or in-app notification
• Changes become effective 30 days after posting (or immediately for legal requirements)

Continued use after changes constitutes acceptance. If you do not agree to the new Terms, you must stop using the service and may terminate your account.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and picovix regarding the service.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

You may not assign or transfer these Terms or your rights hereunder without our written consent. We may assign these Terms without restriction.

We will not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of government, or other force majeure events.
